Tariff Item No. 11
1. For drafting a motion for an enforcement order, a motion for counter-enforcement, a motion for securing a claim, a motion for interim and preliminary measures, objections to the above motions, and responses to objections, the attorney shall be entitled to the fee under Tariff Item No. 7, points 1, 4 and 7.
2. In enforcement proceedings in matters referred to in Tariff Item No. 7, points 2 and 3, the attorney shall be entitled to a one-off fee of 80 points for the entire proceedings, and in proceedings referred to in Tariff Item No. 7, point 9, for drafting a motion for an enforcement order based on an authentic document:
- if the principal claim is up to EUR 40.00, a fee of 5 points;
- if the principal claim is from EUR 40.01 to EUR 100.00, a fee of 10 points.
3. For drafting a motion for a disclosure statement and a disclosure list of assets, the attorney shall be entitled to 50% of the fee under Tariff Item No. 7, points 1, 4 and 7, but not more than 500 points.
4. For drafting a motion to stay enforcement, the attorney shall be entitled to 50% of the fee under Tariff Item No. 7, points 1, 4 and 7, but not more than 500 points.
5. For drafting a motion to the court for ordering and carrying out judicial enforcement on the basis of an enforceable instrument, the attorney shall be entitled to 50% of the fee under Tariff Item No. 7, points 1, 4 and 7, but not more than 500 points.
6. For serving an enforceable instrument on other participants in the enforcement process, the attorney shall be entitled to 50% of the fee under Tariff Item No. 11, points 1 and 2, but not more than 100 points.
7. For drafting a complaint by the enforcement debtor, the attorney shall be entitled to 50% of the fee under Tariff Item No. 11, points 1 and 2, but not more than 100 points.
8. For drafting a request for collection on the basis of a promissory note, the attorney shall be entitled to 50% of the fee under Tariff Item No. 7, points 1, 4 and 7, but not more than 500 points.
9. For drafting auction terms, the attorney shall be entitled to the fee under Tariff Item No. 7, point 1.
10. For drafting other submissions in enforcement or securing proceedings, the attorney shall be entitled to 25% of the fee under Tariff Item No. 7, points 1, 4 and 7, but not more than 250 points.
Tariff Item No. 12
1. For representation at a hearing, the attorney shall be entitled to the fee under Tariff Item No. 7, points 1, 4 and 7, in conjunction with Tariff Item No. 9.
2. For participation in the implementation of enforcement or securing proceedings, the attorney shall be entitled to the fee under Tariff Item No. 7, points 1, 4 and 7, in conjunction with Tariff Item No. 9.
Tariff Item No. 13
1. For drafting legal remedies, the attorney shall be entitled to the fee under Tariff Item No. 7, points 1, 4 and 7.
2. For drafting legal remedies in enforcement proceedings referred to in Tariff Item No. 7, points 2, 3 and 9, the attorney shall be entitled to a fee of 100 points.
