Drafting instruments
Tariff Item No. 33
1. For drafting contracts, the attorney shall be entitled to the fee under Tariff Item No. 7, point 1, increased by 25%.
For contracts determining an annuity, lease, rent and in other similar matters, the contract value shall be the five-year amount of the annuity, lease, rent or other similar payments.
2. For drafting instruments concerning legal transactions whose value cannot be assessed:
- partnership agreements, joint construction agreements, agreements on the manner of use and maintenance of a building, agreements converting ideal co-ownership into condominium ownership of buildings, agreements on division of property following divorce, life-support and support-until-death agreements, agreements on assignment and distribution of property during lifetime, and the like:
- if the contract specifies the value of the contract, the attorney shall be entitled to the fee under point 1 of this Tariff Item;
- if the contract does not specify the value of the contract, the attorney shall be entitled to a fee of 200 points.
3. For drafting a simple and unilateral declaration of intent, the attorney shall be entitled to a fee of 50 points.
4. For drafting a will, the attorney shall be entitled to a fee of 100 points.
For drafting complex testamentary declarations, the fee may be increased by up to 100%.
Legal advice and opinions
Tariff Item No. 34
1. For oral legal instructions, opinions and consultations, the attorney shall be entitled to a fee of 50 points for each commenced hour.
2. For drafting written legal advice and written legal opinions with factual and legal reasoning, the attorney shall be entitled to the fee under Tariff Item No. 7, points 1 and 4.
For drafting written legal advice and written legal opinions with factual and legal reasoning in matters without an assessable value, the attorney shall be entitled to a fee of not less than 200 points.
The attorney shall be entitled to a fee for drafting written legal advice and opinions only if requested by the client.
For drafting written legal advice and opinions which, at the client's request, are provided in a foreign language, the attorney shall also be entitled to a translation fee according to the schedule of fees of permanent court interpreters.
For oral legal instructions, opinions and consultations during the course of proceedings, the attorney shall not be entitled to a separate fee under point 1 of this Tariff Item.
Participation in conferences
Tariff Item No. 35
For participation in conferences and meetings at which factual and legal issues concerning the client's legal matters were discussed with the client, the opposing party and other participants, the attorney shall be entitled to a fee of 50 points for each commenced hour.
Review of files, verification of finality and enforceability, obtaining documents for the client
Tariff Item No. 36
For examining and reviewing files in all proceedings, inspecting land registers, registers and other public books, the attorney shall be entitled to a fee of 25 points for each commenced hour.
For verifying or obtaining certification of finality or enforceability of judgments, decisions and payment orders, the attorney shall be entitled to a fee of 25 points.
For obtaining extracts from land registers, registers of courts or other authorities, or obtaining other documents, the attorney shall be entitled to a fee of 25 points.
Correspondence and demands
Tariff Item No. 37
For drafting correspondence to the client, the opposing party and other participants in the client's legal affairs:
1. For notices and demands setting out the factual situation or providing instructions, the attorney shall be entitled to a fee of 25 points for each page.
2. For standardised demands to the opposing party to pay a specified amount, fulfil an obligation or perform an act, the attorney shall be entitled to a fee of 10 points.
